Enabling development exists to bridge that gap. It allows development that would normally be contrary to planning policy, for example, new housing in the countryside or additional development within sensitive settings, where it is essential to secure the future of a significant heritage asset and where the public benefit decisively outweighs any harm.
Despite its intent, enabling development is often underused and inconsistently interpreted across Northern Ireland. Developers are frequently uncertain about how to make a robust case or how councils will weigh public benefit against policy harm. Drawing on PPS23, the SPPS, and a detailed review of adopted Local Development Plans across Northern Ireland (and informed by feedback from the Revitalise NI Breakfast Forum) we have developed a Framework for Building a Successful Enabling Development Case, comprising seven key tests. These represent the critical questions that any enabling argument must convincingly address to gain planning support. They provide a clear structure for developers and heritage owners to demonstrate how a proposal satisfies both policy intent and public interest, giving decision-makers confidence in the balance between heritage, viability, and wider community benefit.
Test 1 — Heritage Significance and Risk
Establish the importance of the heritage asset and the risks it faces.
Evidence: Statement of Significance, listing citation, condition survey, and risk assessment.
Example Scenario: In the proposed conversion of a vacant 19th-century linen mill, the developer’s design team, working with a conservation-accredited architect or heritage consultant, prepares a Statement of Significance identifying the building’s industrial heritage value and documents its structural deterioration through a condition report.
Test 2 — The Conservation Deficit
Quantify the financial gap between the cost of repairs and the end value once restored.
Evidence: Independent cost plan, valuation report, and viability analysis demonstrating the funding shortfall.
Example Scenario: For the restoration of a listed manor house, the developer commissions a cost consultant and valuer to produce an open-book cost plan and market valuation, coordinated with input from a conservation-accredited architect to ensure heritage repair costs are accurately represented.
Test 3 — Minimum Necessary Development
Prove that the scale of enabling development is the smallest required to bridge the conservation deficit.
Evidence: Sensitivity-tested financial models, alternative options appraisal, and design iterations showing minimisation of impact.
Example Scenario: In a historic mill conversion, the project team tests several development scales with the planning consultant and cost advisor to show that the proposed new-build element represents the minimum required to make the scheme viable.
Test 4 — Public Benefit and Regeneration
Demonstrate how the project delivers measurable public, social, and economic benefit.
Evidence: Economic impact assessment, community access strategy, heritage skills or training initiatives, and sustainability benefits.
Example Scenario: The design team demonstrates how repurposing a redundant courthouse for workspace and café use would create local employment, enhance access to a historic building, and strengthen the vitality of the surrounding town centre.
Test 5 — Design and Conservation Quality
Show that the design enhances rather than compromises the heritage asset.
Evidence: Heritage Impact Assessment, conservation-led design statement, and architectural drawings illustrating the integration of old and new.
Example Scenario: The architect, supported by a heritage consultant, prepares visuals and a Heritage Impact Assessment illustrating how new additions to the rear of a listed terrace remain subservient to the historic frontage.
Test 6 — Delivery and Securing Mechanisms
Guarantee that conservation works will be completed and sustained.
Evidence: Draft Section 76 Agreement linking enabling works to heritage phases, phasing plan, and maintenance strategy.
Example Scenario: The developer’s legal and project management team prepares a Section 76 agreement ensuring that restoration of the historic stables is completed before occupation of the new enabling dwellings.
Test 7 — Sustainability and Long-Term Use
Ensure that the asset will remain viable and beneficial in the long term.
Evidence: Business plan, operator interest, or reuse strategy; lifecycle carbon analysis demonstrating the environmental logic of retention.
Example Scenario: The project team develops a reuse strategy that integrates energy efficiency upgrades and improved operational systems, demonstrating how adaptive reuse supports local sustainability targets and provides a viable long-term use.
